This Terms of Use Agreement ("Agreement") sets forth the legally binding terms for your use of the Positive Poetry Services. By using the Positive Poetry Services, you agree to be bound by this Agreement, whether you are a "Visitor" (which means that you simply browse the Positive Poetry Website, including through a mobile device, or otherwise use the Positive Poetry Services without being registered) or you are a "Member" (which means that you have registered with Positive Poetry).
The term "User" refers to a Visitor or a Member. You are only authorized to use the Positive Poetry Services (regardless of whether your access or use is intended) if you agree to abide by all applicable laws and the terms of this Agreement. Please read this Agreement and save it.
If you do not agree to be bound by this Agreement and to follow all applicable laws, you should leave the Positive Poetry Website and discontinue use of the Positive Poetry Services immediately. If you wish to become a Member, communicate with other Members and/or make use of the Positive Poetry Services, you must read this Agreement and indicate your acceptance during the registration process.
Positive Poetry may modify this Agreement from time to time and such modification shall be effective upon posting by Positive Poetry on the Positive Poetry Website. Your continued use of the Positive Poetry Services after Positive Poetry posts a revised Agreement signifies your acceptance of the revised Agreement. It is therefore important that you review this Agreement regularly to ensure you are updated as to any changes.
1.1 Harassment in any manner or form on the Site including via poems by obscene or abusive language is strictly forbidden.
1.2 Impersonation of others, by members or visitors on the Site is prohibited.
1.3 You may not upload to, distribute, or otherwise publish through this site, any content which is libelous, defamatory, obscene, threatening, invasive of privacy or publicity rights, abusive, illegal, or otherwise objectionable, or which may constitute or encourage a criminal offense, violate the rights of any party or otherwise give rise to liability or violate any law.
1.4 You may not upload commercial content on the Site or use the Site to solicit others to join or become members of any other commercial online service or other organization.
1.5 All decisions regarding the termination of accounts shall be made in the sole discretion of Positive Poetry. Positive Poetry is not required to provide you notice prior to terminating your membership. Positive Poetry is not required, and may be prohibited, from disclosing a reason for the termination of your account. Even after your membership is terminated, this Agreement will remain in effect. All terms that by their nature may survive termination of this Agreement shall be deemed to survive such termination.
